NEW YORK — Sean “Diddy” Combs has filed a new appeal challenging what his lawyers call a “draconian” federal prison sentence, accusing the sentencing judge of acting like a “thirteenth juror.”
Combs’ legal team argues the judge improperly relied on evidence tied to charges the jury rejected — including racketeering and sex-trafficking allegations — when imposing a 50-month sentence. They say this undermined the jury’s verdict and unfairly increased the punishment.
The hip-hop mogul was acquitted of the most serious charges but convicted on two counts of transporting adults across state lines for prostitution. His lawyers contend similar cases typically result in far shorter sentences and are seeking immediate release or a new sentencing hearing.
Prosecutors have not yet responded, and the appeals court has not scheduled arguments.
