Jamaica Crime News, Kingston: Vybz Kartel Appeal – Lawyers representing Adidja “Vybz Kartel” Palmer, Shawn “Shawn Storm” Campbell, Kahira Jones and Andre “Mad Suss” St. John have urged the court not to consider a retrial.
Bert Samuels said such a route would “give the prosecution a second bite at an infected cherry”. This argument was made before judges at the Court of Appeal, Tuesday as the legal team sought to convince the court that the murder case brought against the two entertainers and their co-convicts violated several rights including their right to a fair trial.
Valerie Neita Robertson, as she argued the matter of fairness, submitted to the court that the Judge’s reference to the main witness and the alleged murder victim that “these aren’t soft guys, these guys use to lock guns but they were scared” while speaking to the Jury was highly prejudicial and painted Kartel and his co-appellants as wicked men.
Mrs. Neita Robertson further argued that the presiding Judge in the murder trial acted in breach of accepted standard and placed undue pressure on the Jury when he asked them to return a verdict after the 3:00 p.m. benchmark. Mrs. Neita Robertson says the Judge in doing so facilitated a miscarriage of justice.
The matter is expected to continue on Wednesday as the teams attempt to wrap up their legal arguments.
