Kingston, Jamaica: Vybz Kartel Retrial Hearing – Justice Marva McDonald-Bishop issued a firm directive to defence lawyer Isat Buchanan to remain focused during his presentation at the retrial hearing of dancehall star Vybz Kartel and his co-accused on Wednesday.
Interrupting Buchanan early in his remarks, McDonald-Bishop remarked, “I am lost,” urging him to adhere strictly to his arguments. “Remember this is your last day. Use it wisely… stick to your point,” she cautioned.
Buchanan represents Kartel (real name Adidja Palmer), along with Shawn ‘Shawn Storm’ Campbell, Kahira Jones, and Andre St John, who were convicted for the 2011 murder of Clive ‘Lizard’ Williams. Their convictions, initially upheld by the Court of Appeal in 2020, were overturned by the United Kingdom-based Privy Council on March 14, 2024, due to juror misconduct. The Privy Council mandated the Court of Appeal to determine whether a retrial should be ordered.
Emphasizing the critical importance of context in his opening statement, Buchanan argued against the need for a retrial. “The starting point for me is to say context matters,” Buchanan stated. He underscored that the alleged breaches of the appellants’ rights should be scrutinized within the framework of constitutional supremacy. “The constitution is supreme for us, so that questions that any of the rights alleged by the appellants to have been breached… must be viewed in this context,” Buchanan explained.
The hearing, which commenced on Monday, is anticipated to conclude on Friday, with McDonald-Bishop, alongside Justices Paulette Williams and David Fraser, presiding over the decision.
The legal community and the public closely watch the proceedings, given the high-profile nature of the case and its implications for Jamaica’s legal standards regarding fair trials and juror integrity.
