Florida Police Officer Charged After Allegedly Failing to Disclose HIV Status Before Sexual Encounter

PENSACOLA, Fla. — A 32-year-old officer with the Pensacola Police Department is facing a felony charge following allegations that he engaged in sexual intercourse without informing a partner that he is HIV-positive.

The officer, Pierce Cotton, was taken into custody on Friday and charged under Florida Statute 384.24(2). The law makes it illegal for a person who knows they are infected with the human immunodeficiency virus (HIV) to have sexual relations without first notifying their partner and obtaining consent.

Under the statute, individuals who are aware of their HIV-positive status and understand that the virus can be transmitted through sexual contact must disclose this information before engaging in intercourse. Failing to do so is classified as a third-degree felony in the state of Florida.

Following the arrest, the Pensacola Police Department confirmed that Cotton has been placed on administrative leave while the matter is reviewed internally. Authorities say an internal affairs investigation has also been launched.

According to jail records, Cotton was released later Friday after posting a $10,000 bond.

Officials noted that Cotton’s mugshot has not been released because it is protected from public disclosure under Florida law.

Prior to the incident, Cotton had received recognition from the department. In February 2023, he was awarded the Life Saving Award for rescuing and reviving a man who was discovered drowning in a swimming pool at a local hotel.
