Privy Council Rules INDECOM Does Not Have Power To Arrest, Prosecute Police

Independent Commission of Investigations (INDECOM)  the body that investigates excesses by the security forces does not have the power to arrest and prosecute police officers.

This is the ruling of the UK Privy Council that has dismissed an appeal by INDECOM over whether it has the power to arrest and prosecute members of the Jamaica Constabulary Force.

The ruling was handed down in London, England May 4. INDECOM had gone to the Privy Council to ask it to quash a ruling by the Court of Appeal that it had no powers in law  to arrest and prosecute police.

The UK Privy Council says that based on the law that governs the operations of INDECOM it is clear that the Commission’s role is investigative.
