MARGATE, FL (Mckoy’s News) – BIG PENIS in Murder Trial: A man facing a murder charge for the death of his girlfriend is using the defence that she choked to death on his Big Penis, during oral sex.
The Big Penis defence trial began on Tuesday, May 16.
Defence attorney filed a motion to show his penis as evidence to the jury, but the judge has not ruled yet this member of his body will be displayed in court. The prosecution reportedly does not object to him showing the jury his penis, however, they argued about if he would need to be erect or not when it is on display.
Prosecution Argued:
“Do we do it in the back? Do we do it in open court?” assistant state attorney Peter Sapak asked. “How is the defendant going to be erect when the jury views it? Because a flaccid penis, whether it be a picture or the jury actually seeing it, is completely irrelevant. It needs to be erect.”
Richard Patterson, 65-year-old of Margate, charged with second-degree murder in connection with the death of his girlfriend Francisca Marquinez, 60- year-old, says Marquinez allegedly choked to death while performing oral sex on him in 2015. He is using the Big Penis in Murder Trial defence as evidence her death was an accident.
Patterson’s lawyer is concern that under such pressure his client may not be able to hold an impressive enough erection to convince the jury when he is facing such a serious charge.

Patterson’s lawyers argued that Marquinez died accidentally in the heat of passion, but associate Broward County medical examiner Iouri Boiko said he has never come across such a case. Boiko, who performed Marquinez’s autopsy, testified Thursday that her airway would have had to have been blocked for two to three minutes.
“I don’t think it’s possible,” Boiko stated, according to the Sun Sentinel.
He said there would have been a clear sign of struggle in her autopsy if she died that way .
“If she cannot breathe, she usually start to kicking, biting or to do something to prevent this blocking of the airway, try to open this airway,” said Boiko. “It’s (a) normal reaction of any person.”
According to defence lawyer Ken Padowitz, Patterson did not notice anything wrong with Marquinez until after he returned from the bathroom 15 minutes later after the oral sex was over.
Patterson, did not immediately call the police after he found that Marquinez was dead, he let her body decompose for 24 hrs. Autopsy was not able to determine the cause of death because of her state of decomposition.
As for the defence of a ” big penis in murder trial,” the court is still awaiting the ruling.
If convicted, Richard Patterson could face life in prison.
